Module Description

This module targets the Legal observation, Contractual responsibilities and processes together with complying with various legislations  pertaining to the real estate intermediation business, mainly the “Real Estate Agents, Property Brokers and Property Consultants Act Chapter 615”..

Entry Requirements

Students should be in possession of a minimum School Leaving Certificate MQF Level 3

AND

License of real estate manager

AND/OR

Be in possession of one of the following:

(a) Secondary Education Certificate in English as issued by Matsec at grade 5 or higher.”

(b) Or IELTs 6.0

(c) Or an equivalent qualification.

Audience

Learning Outcomes

At the end of the module/unit the learner will have acquired the responsibility and autonomy to:

  1. Understand the “Real Estate Agents, Property Brokers and Property Consultants Act” (Chapter 615).
  2. Capable to comply with all legislation within the same act.
  3. Abide and comply with PMLFT Legislation.
  4. Understand that all general legislations regulating Advertising, GDPR, Marketing and other related legislations are observed within the practice of the Real Estate profession.
  5. Identify and rectify any potential breaches within the said Act in a legal way.
  6. Capable of complying with Contractual Process documentation requirements.
  7. Capable to give clear opinion on the contractual process.
  8. Identify any preliminary promise of sale and contractual deficiencies

At the end of the module/unit the learner will have acquired the following skills:

  1. Understand the practical in complying with “Real Estate Agents, Property Brokers and Property Consultants Act (Chapter 615)”.
  2. Assess contract process and required documentation.
  3. Capable of collecting, storing and reporting any findings as required by MLRO function in line with PMLFT Legislation.
  4. Capable to identify any initial contractual implications.
  5. Capable to identify and procure collection, storing and distribute personal data in line with GDPR Legislation.

Assessment

This module shall be assessed by way of an assignment.  Learners must obtain a minimum of 50% of the total mark to successfully pass from the module. In the case that learners do not pass on the first try, learners can re-sit the examination. In the case of recurring failure, learners shall be asked to re-do the module.
